Specific instances handled by the Spanish NCP

The Spanish NCP has handled 6 specific instances. The first four were handled before the Procedural guidance was published, therefore they don't have a final statement. However, a summary of these instances can be found in the OECD website in this link.


- Specific instance E-00001: trade union - financial institution (Venezuela)

In May 2004 the Spanish NCP received a request for review from a trade union alleging that a Spanish-owned company had breached the employment and industrial relations provisions of the Guidelines in Venezuela.

The NCP met with the notifier and, after this meeting, requested further information. The trade union never supplied the additional information and in due course the NCP concluded the specific instance.


- Specific instance E-00002: trade union - multinational enterprise (Perú)

In December 2004 the Spanish NCP received a request for review from a trade union alleging that a multinational enterprise had breached the employment and industrial relations provisions of the Guidelines in Peru. Specifically the trade union alleged that workers from a local Peruvian company which had been taken over by an Spanish company received lower salaries than workers doing the same kind of work for the buyer company.

The NCP entered into contact with the trade union and the company an the two parties reached an agreement. The NCP duly concluded the specific instance.


- Specific instance E-00003: individuals - several financial institutions (Spain)

In July 2012 the Spanish NCP received 15 requests for review from an individual alleging that several financial institutions had breached the consumer interest's provisions of the Guidelines in Spain. Specifically it was alleged that the financial institutions did not provide all relevant information to their clients before the sale of complex financial products.

After completing an initial assessment, the NCP concluded the specific instance because all the issues at stake were beind dealt with by the relevant national authorities.


- Specific instance E-00004: individual - financial institution (Spain)

In July 2012 the Spanish NCP received a request for review from an individual alleging that a multinational bank had breached the consumer interests provisions of the Guidelines in Spain. Specifically it was alleged that there was a lack complete and transparent information provided by the bank selling preferred stocks to individuals.

After receiving the specific instance, the NCP asked the individual to submit additional information but never received a reply. After some time the NCP concluded the specific instance.


- Specific instance E-00005: UNI Global Union - Prosegur (Br, Col, Par, Pe, Ch)

In November 2013 a trade union, UNI Global Union, submitted a specific instance to the Spanish NCP. Prosegur had supposedly breached the OECD Guidelines for Multinational Enterprises in several of its Latin American subsidiaries.

The specific instance was accepted for further examination in March 2014. The NCP offered good offices and held several meetings with the parties. Nonetheless, on May 31st 2016 the NCP decided to close de specific instance by unanimity, after the Advisory Body had expressed its position.

The NCP issued a recommendation for the company, which had to carry out due diligence in its Latin American subsidiaries. The secretariat will conduct a follow up on year after the publication of the final statement.

- Specific instance E-00006: individual - Iberdrola (Spain)

On July 31st 2017 an individual submitted a complaint before the Spanish NCP in regard to the Spanish multinational Iberdrola supposedly breaching the Guidelines. In particular, according to the claimant Iberdrola had damaged several elements of its property while working on the maintenance of the electrical grid located near the house.

The NCP has adopted the role of mediator, maintaining a close contact with the parties in order to solve the claim. Iberdrola has met all the claims.

During the February 15th 2018 NCP plenary meeting their members decided to close the case by unanimity, after the Advisory Body has expressed its position.
